Allen Price was commissioned to prepare a Development Application for an innovative project in Gerringong, featuring a combined medical centre and medium-density housing development. The proposed two-storey building was designed with the medical centre on the ground floor and three residential units on the first floor. Additionally, a basement car park was included to provide convenient parking for both the medical centre and the residential units.
Allen Price was responsible for project managing the preparation of the Development Application, including key town planning reports such as the Statement of Environmental Effects and a Clause 4.6 Variation Statement to address non-compliance with the statutory building height of the Shoalhaven Local Environmental Plan 2024.
In addition to managing the town planning inputs, we played a key role in designing the engineering elements of the project. Despite our comprehensive approach, the initial application was refused by the council due to concerns over the building height non-compliance and other matters. However, we remained committed to the project and initiated an appeal to the Land and Environment Court. Our team of experienced town planners actively contributed to the legal process by providing expert evidence during court proceedings.
In mid-2018, the court ruled in our favour, granting approval for the project.
This successful outcome underscored our ability to navigate complex regulatory environments and resolve planning disputes, delivering results that aligned with both the client’s vision and the statutory framework. The project stands as a testament to our expertise in overcoming challenging planning obstacles and securing favourable outcomes through legal avenues.
